These Terms and Conditions set out the basis on which we provide rubbish removal and waste collection services in and around Kentish Town. By making a booking, confirming a quotation, or allowing our team to commence work at your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 Services means the rubbish removal, waste collection, waste clearance, load and go, and related services we provide.

1.2 Customer, you or your means the individual, business, landlord, tenant, or other organisation requesting the Services.

1.3 We, us or our means the rubbish removal service provider trading in Kentish Town under whose name your booking is confirmed.

1.4 Premises means the property, site, or location where the Services are to be carried out.

1.5 Waste means the items, materials, rubbish, junk, debris, or other goods presented for removal as part of the Services, excluding any items we specifically refuse or which are prohibited by law.

1.6 Contract means the legally binding agreement between you and us for the supply of Services in accordance with these Terms and Conditions.

2. Scope of Services

2.1 We provide rubbish removal and waste collection Services for domestic, commercial and other clients. The precise scope of the Services will be as set out in our quotation or booking confirmation.

2.2 The Services may include the loading, removal, transportation and disposal or recycling of Waste from the Premises, subject to applicable waste regulations and these Terms and Conditions.

2.3 We reserve the right to refuse to handle or remove any items that are hazardous, illegal, excessively heavy, contaminated, or otherwise unsuitable for collection, including but not limited to asbestos, clinical waste, certain chemicals, gas cylinders, explosives and items containing persistent organic pollutants where we are not licensed or equipped to deal with them.

3. Booking Process

3.1 Bookings may be made by telephone, email or through our online enquiry or booking system, where available. All bookings are subject to availability and acceptance by us.

3.2 When you contact us, we may request information including your name, contact details, service address, description of the Waste, access information, preferred date and time, and any other relevant details necessary to provide the Services.

3.3 We may offer an estimated price based on the information you provide. This estimate is not binding and may be adjusted on site once our team has inspected the Waste, assessed access conditions and confirmed the load size.

3.4 A Contract is formed when you accept our quotation or when we confirm your booking in writing or verbally and you indicate acceptance, whichever occurs first.

3.5 You warrant that all information provided to us in relation to the booking is complete and accurate to the best of your knowledge, and that you have the authority to request the removal of the Waste from the Premises.

4. Access and Customer Responsibilities

4.1 You must provide us, our employees and contractors with safe, reasonable and timely access to the Premises to carry out the Services. This includes providing necessary keys, entry codes, parking permissions, loading bay access or delivery instructions where applicable.

4.2 You are responsible for ensuring that the Premises are safe for our team to work in. You must inform us of any relevant health and safety risks, including structural defects, dangerous animals, hazardous materials or other circumstances that could affect the safe delivery of the Services.

4.3 You must ensure that the Waste to be removed is clearly identified, separated from items not to be removed, and free from prohibited or hazardous materials unless separately agreed in writing.

4.4 If, in our reasonable opinion, the Premises are unsafe or access is unduly restricted or impossible, we may suspend or cancel the Services, or charge additional fees to reflect extra time, labour or equipment required.

5. Pricing, Quotations and Additional Charges

5.1 Our prices are typically based on the volume and type of Waste, weight limitations, labour involved, and distance from the vehicle, as well as any additional services requested.

5.2 Any quotation we provide is an estimate based on the information you supply. The final price may change following a site inspection if the actual volume, weight or nature of the Waste, or the working conditions, differ from those described.

5.3 We will inform you of any change to the price before commencing work. If you do not agree to the revised price, you may cancel the Service visit, but we may charge a call-out or cancellation fee to cover our costs.

5.4 Additional charges may apply for:

a extra labour time beyond the standard allowance per load;

b difficult or restricted access involving stairs, long carries or dismantling;

c items requiring special handling, such as fridges, mattresses, tyres or electrical items;

d waiting time where our team is unable to start work due to your act or omission;

e parking fees, congestion or clean air zone charges, tolls, or penalties incurred as a direct result of the service location or your instructions, except where caused by our own fault.

6. Payments and Invoicing

6.1 Unless otherwise agreed in writing, payment is due in full upon completion of the Services on the day of collection. We may request a deposit or full prepayment to secure your booking, particularly for larger jobs.

6.2 We accept common payment methods, which may include cash, credit or debit card, bank transfer or other methods notified by us from time to time. We do not accept cheques unless expressly agreed in advance.

6.3 For business Customers with approved accounts, payment terms will be as stated on the invoice, typically a specified number of days from the invoice date. Time for payment shall be of the essence.

6.4 If you fail to make any payment by the due date, we may:

a charge interest on the overdue amount at the statutory rate permitted under UK law until payment is received in full; and

b suspend or cancel any further Services until all outstanding sums are paid.

6.5 All prices are stated exclusive of VAT unless otherwise indicated. Where VAT applies, it will be added at the prevailing rate.

7. Cancellations, Rescheduling and No-Show

7.1 You may cancel or reschedule your booking by giving us reasonable notice prior to the agreed arrival time.

7.2 If you cancel more than 24 hours before the scheduled Service time, no cancellation fee will normally apply, unless we have incurred non-refundable costs or agreed otherwise in writing.

7.3 If you cancel within 24 hours of the scheduled Service time, or if our team arrives at the Premises and is unable to carry out the work due to reasons within your control, we may charge a cancellation or call-out fee to cover our time, travel and administrative costs.

7.4 We will use reasonable efforts to arrive within the agreed time window, but arrival times are approximate and subject to traffic, weather and operational factors. We will not be liable for minor delays, provided we perform the Services within a reasonable time.

7.5 In the unlikely event that we need to cancel or significantly reschedule your booking, we will notify you as soon as reasonably practicable and offer a new date or a refund of any amount you have paid in advance for Services not provided. We will not be liable for any indirect or consequential loss arising from such cancellation.

8. Waste Handling and Regulations

8.1 We operate in accordance with applicable UK waste legislation and guidance. We will transport and dispose of Waste only at authorised facilities and will use reasonable care to maximise recycling and recovery where practicable.

8.2 By presenting Waste for collection, you confirm that you are the owner of the Waste or that you have full authority from the owner to dispose of it.

8.3 You must not knowingly include in the Waste any items that are prohibited, hazardous, or regulated beyond our licensing, including but not limited to asbestos, clinical or medical waste, certain chemicals, radioactive materials or pressurised containers, unless expressly agreed in writing and compliant with law.

8.4 We may, at our discretion, refuse to remove any Waste we reasonably suspect to be hazardous, unlawful, incorrectly described, or otherwise unsuitable. You will remain responsible for such items.

8.5 Once the Waste is loaded onto our vehicle, title to the Waste passes to us and you will have no further claim to it, subject to any exception explicitly agreed in writing.

9. Damage, Liability and Insurance

9.1 We will exercise reasonable care and skill in the performance of the Services. Our teams are trained to carry out rubbish removal and waste collection safely and responsibly.

9.2 We hold appropriate public liability insurance for our activities. Details are available on request.

9.3 We shall not be liable for any pre-existing damage to your property, fixtures, fittings or belongings. You should highlight any fragile, unusual or high-value items and take reasonable steps to protect them before the Service visit.

9.4 Except where caused by our negligence or breach of duty, we are not responsible for damage resulting from:

a the movement of bulky or heavy items through tight spaces, stairwells or doorways where damage is reasonably foreseeable;

b your failure to protect or remove personal belongings or delicate items from working areas;

c insufficient or inaccurate instructions provided by you or your representative.

9.5 Where we are found liable for loss or damage, our total liability to you in respect of each Contract, whether arising in contract, tort including negligence, breach of statutory duty or otherwise, shall not exceed the total price paid or payable for the Services under that Contract, except in cases where liability cannot lawfully be limited.

9.6 We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be lawfully excluded or limited under UK law.

9.7 We shall not be liable for any loss of profit, loss of business, loss of opportunity, or any indirect or consequential loss arising out of or in connection with the Services, even if such loss was reasonably foreseeable.

10. Customer Conduct and Staff Safety

10.1 We are committed to providing a professional, respectful and safe working environment. Our staff and contractors must not be subjected to abuse, harassment, threats or violence.

10.2 If our team experiences abusive behaviour or reasonably believes their safety is at risk, we may suspend or terminate the Services with immediate effect. In such cases, you may still be liable for call-out or cancellation charges.

11. Complaints and Dispute Resolution

11.1 If you are dissatisfied with any aspect of the Services, you should notify us as soon as possible, ideally on the day of service, so that we have an opportunity to address your concerns.

11.2 We will investigate complaints reasonably and promptly, and may request additional information, photographs or access to the Premises where relevant.

11.3 Where we agree that the Services have not been performed with reasonable care and skill, we may, at our discretion, offer to re-perform the Services, provide a partial refund or agree another appropriate remedy in accordance with your statutory rights.

12. Force Majeure

12.1 We shall not be in breach of these Terms and Conditions or otherwise liable for any delay in performing, or failure to perform, any of our obligations if such delay or failure results from events, circumstances or causes beyond our reasonable control, including but not limited to extreme weather, accidents, traffic disruption, strikes, utility failures, acts of God, or restrictions imposed by authorities.

12.2 If a force majeure event prevents us from providing the Services for a period of more than 14 days, either party may cancel the affected Contract without penalty. You will be entitled to a refund of any amounts paid in advance for Services not performed.

13. Data Protection and Privacy

13.1 We may collect and process personal information such as your name, contact details and service address for the purposes of managing your booking, delivering the Services, handling payments and complying with legal obligations.

13.2 We will handle your personal data in accordance with applicable UK data protection laws and will take reasonable steps to keep such data secure. We will not sell your personal information to third parties.

13.3 We may share your details with trusted third parties involved in delivering the Services, such as payment processors or waste disposal facilities, only to the extent necessary to perform the Contract or meet legal requirements.

14. Variations to these Terms

14.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to your Contract.

14.2 Any variation to these Terms and Conditions requested by you shall be ineffective unless agreed in writing by us.

15. Severability

15.1 If any provision or part-provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed deleted and the remaining provisions shall continue in full force and effect.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation including non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 You and we irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.

By confirming a booking or allowing our team to commence work, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions for rubbish removal and waste collection services.
